This Client Service, Payment, Refund & Cancellation Policy ("Policy") explains the terms that apply to services provided by Sowing the Seeds ("Sowing the Seeds," "we," "us," or "our"). By purchasing or engaging Sowing the Seeds for services, you ("Client," "you," or "your") acknowledge that you have read, understood, and agreed to the terms outlined below.

This Policy should be read together with our Terms & Conditions and Privacy Policy, which govern your use of the Sowing the Seeds website and services.

1. Services

Sowing the Seeds provides digital services that may include, but are not limited to:

  • Website design and development

  • Website setup and customization

  • Search engine optimization (SEO)

  • Google Business Profile optimization

  • Social media branding and setup

  • Social media content and marketing support

  • Digital marketing services

  • Website maintenance

  • Other digital services specifically agreed upon between Sowing the Seeds and the Client

The specific services, deliverables, timeline, and price for each project will be communicated to the Client before work begins and may be documented through a proposal, invoice, service agreement, email, or other written communication.

Sowing the Seeds reserves the right to determine which services it offers and to decline a project when appropriate.

2. Project Scope

Each project is limited to the services and deliverables agreed upon between Sowing the Seeds and the Client.

Requests that fall outside the original project scope may require an additional fee. Sowing the Seeds will communicate any additional charges to the Client before performing substantial additional work.

Examples of potential additional work may include:

  • Additional website pages

  • Significant redesigns

  • Additional revisions beyond the agreed-upon amount

  • Additional functionality or integrations

  • Additional social media platforms

  • Additional SEO or marketing services

  • Significant changes to previously approved content or design

  • Ongoing website maintenance

3. Client Responsibilities

To complete a project efficiently, the Client agrees to provide accurate and timely information, materials, approvals, and access reasonably required to perform the services.

Depending on the project, this may include:

  • Business information

  • Logos and brand materials

  • Photos and videos

  • Written content

  • Social media account access

  • Google Business Profile access

  • Domain or hosting access

  • Third-party platform credentials or permissions

  • Legal or compliance information specific to the Client's business

  • Timely feedback and approvals

Sowing the Seeds is not responsible for delays caused by the Client's failure to provide necessary information, materials, access, or approvals.

If a project is delayed because required materials or communication are not provided, the original estimated completion date may be adjusted.

4. Pricing and Payment

All prices will be communicated to the Client before services begin.

Payment may be required in full or in installments depending on the project.

Unless otherwise agreed in writing:

  • Work will not begin until the required initial payment has been received.

  • Any remaining balance is due according to the payment schedule provided to the Client.

  • Final website files, access, launch, or other final deliverables may be withheld until the applicable balance has been paid in full.

  • The Client is responsible for applicable third-party costs associated with their project unless specifically stated otherwise.

Website design and development fees and ongoing website maintenance or third-party fees are separate charges unless expressly stated otherwise in writing.

Third-party costs may include, but are not limited to:

  • Domain registration and renewal

  • Website hosting

  • Premium website themes, plugins, or applications

  • Business email services

  • Website security or backup services

  • SEO or marketing subscriptions

  • Paid software

  • Stock photography

  • Advertising costs

  • Printing

  • Other third-party products or services

Sowing the Seeds will not be responsible for recurring third-party charges unless explicitly agreed upon in writing.

5. Payment Plans

If a payment plan is offered, the Client agrees to make each payment by the due date specified in the applicable agreement or invoice.

Failure to make a scheduled payment may result in:

  • Pausing work on the project

  • Delaying delivery of remaining services

  • Withholding final deliverables

  • Suspending services provided directly by Sowing the Seeds

  • Cancellation of the project after reasonable notice

Sowing the Seeds reserves the right to pursue unpaid balances or take other actions permitted by law.

6. Website Projects and Launch

For website projects, the estimated turnaround time will be communicated before or at the beginning of the project.

Estimated timelines depend on the Client providing the required content, information, approvals, and access in a timely manner.

A website may be considered ready for launch once the agreed-upon deliverables have been completed and the Client has had a reasonable opportunity to review them.

If the Client does not provide requested feedback or approval within a reasonable period, Sowing the Seeds may consider the project delayed due to Client inactivity.

The Client is ultimately responsible for reviewing and approving the accuracy of information displayed on their website before launch.

7. Revisions

The number of revisions included in a project will depend on the specific service agreement or package purchased.

A revision generally means a reasonable modification to an existing design or piece of content.

Requests for an entirely new design, substantial restructuring, additional pages, or work outside the original scope may be treated as additional services and may result in additional charges.

8. No Refund Policy

All payments made to Sowing the Seeds are non-refundable. All sales are final.

Because Sowing the Seeds provides customized digital services and begins work based on the Client's specific project, payments, deposits, and fees are non-refundable once submitted.

This includes, but is not limited to:

  • Website design and development

  • Website setup and customization

  • SEO services

  • Google Business Profile optimization

  • Social media setup and branding

  • Digital marketing services

  • Website maintenance

  • Custom design work

  • Deposits or initial payments

  • Payments made under a payment plan

  • Other customized services provided by Sowing the Seeds

If a Client chooses to cancel a project after payment has been made, the Client is not entitled to a refund of amounts already paid.

If a Client becomes unresponsive, fails to provide required materials or information, changes their mind about the project, or otherwise prevents the project from being completed, payments already made remain non-refundable.

Third-party expenses paid on behalf of the Client are also non-refundable to the extent permitted by the applicable third-party provider and applicable law.

Nothing in this Policy is intended to waive or restrict any refund, cancellation, or other consumer right that cannot legally be waived under applicable law.

9. Client Cancellation

A Client may request to cancel a project at any time by contacting Sowing the Seeds in writing.

Cancellation of a project does not create a right to a refund.

If the Client cancels after work has begun, the Client remains responsible for any unpaid amounts that have become due under the applicable service agreement or payment plan.

Cancellation also does not automatically release the Client from payment obligations for work, services, or expenses already incurred.

10. Sowing the Seeds Cancellation

Sowing the Seeds reserves the right to pause or terminate a project or service when reasonably necessary, including circumstances involving:

  • Nonpayment

  • Repeated failure to communicate

  • Failure to provide required materials or access

  • Abusive, threatening, discriminatory, or inappropriate conduct

  • Requests for unlawful or unethical activity

  • Material misrepresentation of information

  • Circumstances that make completion of the project impractical

  • Breach of the applicable agreement or these terms

If Sowing the Seeds terminates a project, any refund will be determined only if Sowing the Seeds voluntarily agrees to provide one or if a refund is required by applicable law.

Except where required by applicable law, termination by Sowing the Seeds does not create an automatic right to a refund.

11. Project Abandonment

If a Client becomes unresponsive or fails to provide required materials, information, approvals, or access for an extended period, Sowing the Seeds may consider the project inactive or abandoned after reasonable attempts to contact the Client.

Before closing an inactive project, Sowing the Seeds may provide written notice allowing the Client an opportunity to respond.

Payments made toward an abandoned project remain non-refundable.

If the Client later wishes to resume an abandoned project, Sowing the Seeds may require a revised timeline, additional fees, or a new agreement depending on the circumstances.

12. Website Maintenance, Hosting, Domains & Recurring Fees

Website design and development fees generally cover the services and deliverables specifically outlined in the Client's project agreement. Ongoing website maintenance and third-party services may require separate recurring fees.

Depending on the Client's website and selected services, recurring costs may include:

  • Website hosting

  • Domain name registration and renewal

  • Premium website themes, plugins, or applications

  • Business email services

  • Website security or backup services

  • SEO or marketing subscriptions

  • Third-party integrations

  • Other software or services necessary for the continued operation of the website

These costs may be billed monthly, annually, or according to the billing schedule established by the applicable third-party provider.

Unless specifically stated otherwise in writing, recurring third-party fees are not included in the website design or development fee and are the responsibility of the Client.

Sowing the Seeds may assist with setting up or managing certain third-party services on the Client's behalf. However, the Client remains responsible for applicable recurring charges.

If Sowing the Seeds pays a recurring third-party expense on behalf of the Client, the Client may be required to reimburse Sowing the Seeds according to the agreed billing arrangement.

Failure to pay required hosting, domain, software, maintenance, or other recurring fees may result in the suspension, expiration, or termination of the applicable service.

Sowing the Seeds is not responsible for loss of website availability, domain ownership, website content, email services, or other functionality resulting from unpaid or expired third-party services.

Clients will be informed of applicable recurring fees before being enrolled in a recurring service managed or arranged by Sowing the Seeds.

Website Maintenance Services

Ongoing website maintenance provided directly by Sowing the Seeds may also be available for an additional recurring fee.

Maintenance services may include, depending on the selected plan:

  • Website content updates

  • Image or text changes

  • Basic website updates

  • Technical assistance

  • Website monitoring

  • Minor design adjustments

  • Other agreed-upon maintenance services

The specific services included, frequency, pricing, and billing schedule for any maintenance plan will be communicated to the Client before the recurring service begins.

Website maintenance is separate from the initial website design and development service unless otherwise stated in writing.

13. Third-Party Services

Sowing the Seeds may use or recommend third-party platforms and services to complete a project.

These may include website hosting providers, domain registrars, email platforms, social media platforms, Google services, payment processors, scheduling systems, or other technology providers.

Sowing the Seeds does not control the policies, availability, pricing, security, or performance of third-party services.

The Client is responsible for reviewing and agreeing to the applicable terms and policies of third-party providers.

14. Client-Owned Accounts and Information

Whenever reasonably possible, accounts created specifically for the Client's business should be established in the Client's name or under an account controlled by the Client.

The Client remains responsible for maintaining appropriate ownership, billing information, passwords, security, and access to their business accounts.

Sowing the Seeds does not guarantee permanent access to or control over third-party platforms after a project has been completed.

15. Content and Legal Compliance

The Client is responsible for ensuring that materials provided to Sowing the Seeds may legally be used and published.

This includes responsibility for:

  • Copyright permissions

  • Trademark rights

  • Licenses

  • Business claims

  • Testimonials

  • Photographs

  • Customer information

  • Pricing and promotional claims

  • Industry-specific disclosures

  • Required legal notices

Sowing the Seeds may assist with formatting, design, and implementation but does not provide legal advice or guarantee that a Client's website or marketing materials comply with every law or regulation applicable to the Client's particular industry or location.

16. No Guarantee of Business Results

Sowing the Seeds will make reasonable efforts to provide professional digital services; however, we do not guarantee specific business results.

Results from websites, SEO, Google Business Profile optimization, social media, or other marketing services may vary depending on numerous factors outside our control.

We do not guarantee:

  • A specific number of customers

  • A specific amount of revenue

  • Search engine rankings

  • Social media followers or engagement

  • Leads

  • Sales

  • Advertising performance

  • Google Business Profile placement

  • Any specific return on investment

17. Monthly Seed Complimentary Websites

The Monthly Seed is a complimentary initiative offered by Sowing the Seeds and is separate from paid client services.

Sowing the Seeds may aim to provide one complimentary website or other digital service opportunity during a given month, but this is a goal rather than a guarantee.

Submitting a Monthly Seed nomination does not guarantee selection.

Sowing the Seeds may consider factors such as:

  • The business's circumstances

  • The potential impact of the assistance

  • Project feasibility

  • Availability and capacity

  • Information provided through the nomination form

  • Alignment with the purpose of the Monthly Seed initiative

Sowing the Seeds may contact nominees for additional information before making a decision.

There is no purchase necessary to submit a nomination.

Selection, timing, scope, and deliverables for a Monthly Seed project are determined by Sowing the Seeds and will be communicated to the selected recipient.

Complimentary Monthly Seed services may have limitations that differ from paid services.

Any recurring hosting, domain, software, maintenance, or other third-party expenses associated with a complimentary Monthly Seed website will be communicated to the recipient before those expenses are incurred and may remain the recipient's responsibility unless Sowing the Seeds expressly agrees otherwise in writing.

18. Partner Network

Participation in the Sowing the Seeds Network is subject to review and approval by Sowing the Seeds.

Being listed as a Partner does not constitute an endorsement, certification, guarantee, or legal verification of a Partner's business, services, products, qualifications, or conduct.

Partners remain responsible for their own businesses and customer relationships.

Sowing the Seeds may remove, modify, or decline a Partner listing when reasonably necessary.

19. Disputes and Communication

If you have a concern regarding a service, payment, refund, cancellation, or project, please contact Sowing the Seeds directly so that we have an opportunity to review the matter and work toward a resolution.

Any dispute will be handled in accordance with the applicable agreement and applicable law.

Nothing in this Policy is intended to limit rights or remedies that cannot legally be waived.

20. Changes to This Policy

Sowing the Seeds may update this Client Service, Payment, Refund & Cancellation Policy from time to time.

The updated version will be posted on this website with a revised "Last Updated" date.

Any changes will apply prospectively unless otherwise required by law.
